Asbestos in an older building: legal requirements before renovation

Finding asbestos midway through renovation means stopping work and appointing a certified contractor. A survey is best completed before the project begins.

Why this affects older Barcelona buildings

Spain banned asbestos in 2002. Buildings constructed or renovated before then often contain asbestos-cement materials in roofing, water tanks, old pipe insulation and certain floor coverings. For an investor working with a typical DNPI asset—an older central Barcelona building for refurbishment—this is a likely scenario rather than a rare exception, especially in pre-war or post-war buildings.

What the law regulates

RD 396/2006 governs work involving asbestos exposure risks. Before demolition or renovation that may disturb asbestos-containing materials, current regulations require a company registered in RERA (Registro de Empresas con Riesgo de Amianto). Work must follow a specific work plan, and the resulting waste must be handled as hazardous and disposed of through an authorised operator.

An individual or ordinary building contractor without RERA registration has no legal right to remove these materials themselves. This is a direct legal requirement, rather than a choice of a cheaper contractor.

The rules cover more than complete demolition. Less obvious examples include removing old flooring or dismantling a roofing sheet, which may initially look like routine renovation rather than hazardous-material work.

Where this belongs in the process

An asbestos survey should form part of the technical inspection before refurbishment, alongside assessment of the structure and services. The reason is straightforward: discovery midway through a project means stopping work, engaging a certified RERA contractor and accepting an unplanned delay just when the programme and budget have already been agreed with the team and possibly a buyer or tenant.

For an investor, the quality of the preliminary survey directly affects the predictability of the whole programme. Savings at this stage almost always lead to a more expensive and less predictable stoppage later.

A practical sequence:

  1. Include an asbestos check in the preliminary technical survey, particularly for buildings constructed before 2002.
  2. If materials are found, identify the affected elements before work begins and establish whether removal requires a RERA contractor.
  3. Include the cost in the overall refurbishment budget during planning, rather than responding to a discovery during construction.
  4. Do not use an ordinary crew without the relevant registration for removal: that breaches regulations rather than merely saving money.
