Modelo 720: when overseas-asset reporting affects an investor

Only Spanish tax residents report foreign assets through Modelo 720. The form does not apply to a non-resident's Barcelona flat.

Who must consider this form

Modelo 720 is an information return rather than a tax return: it requires disclosure, not a tax payment. Spanish tax residents file it for assets held abroad—bank accounts, securities and property—where prescribed thresholds are exceeded. It does not concern a non-resident's assets in Spain. A foreign investor who buys a Barcelona flat and remains non-resident does not file Modelo 720 for that property. Their Spanish-property tax obligations fall under IRNR and Modelo 210, covered separately.

When it becomes relevant

Modelo 720 becomes a question for someone becoming Spanish tax-resident under the ordinary regime while retaining property or other assets abroad. An important exception applies to people taxed under article 93 LIRPF, the special inbound-worker or Beckham regime: AEAT states that they are not required to file Modelo 720. Residence alone therefore does not settle the question; identify the applicable tax regime first.

This transition is significant. Someone can own a Spanish flat as a non-resident for years without ever considering Modelo 720. Once they transfer tax residence to Spain under the ordinary regime, perhaps to manage projects personally, retained overseas assets may trigger a separate information obligation. A change of tax residence is the specific point at which to establish whether Modelo 720 requirements apply to overseas assets. The rule concerns people whose residence status changes, rather than those remaining non-resident with only a Spanish asset. A careful initial check is preferable to dealing later with a missed return.

Reporting thresholds and penalties for this form changed following EU-level proceedings against Spain's original severe sanctions. Confirm current threshold amounts and consequences of non-filing with a tax adviser when residence status changes, rather than relying on outdated information. This is precisely a case for checking the rules afresh instead of relying on something read several years ago: the regime changed, and figures in an old article or forum discussion may no longer reflect current requirements.
