Usucapión: a limited but real property purchase risk

For a registered flat in central Barcelona, usucapión is largely theoretical. Land with an incomplete title history is a different matter.

Acquisition by usucapión is a means of acquiring ownership or another property right through continuous possession for the statutory period. The Civil Code distinguishes good-faith possession with a lawful basis (título), requiring a shorter period, from possession without those conditions, requiring substantially longer. Over time, the law recognises prolonged factual possession as a legal right even where the possessor's original formal title was defective or absent. This balances protection of the formal owner against stability in arrangements established over many years.

Why the risk is minimal for a registered flat

The Registro de la Propiedad gives registered owners substantial protection. The principle of fe pública registral, or public reliance on the register, works in their favour and narrows the scope for another person's possession to become a right over time. For an ordinary central Barcelona flat with clear title history and registry entry, usucapión is more theoretical than practical. Registration closes off most scenarios in which prolonged third-party possession could compete with registered ownership, which is why the issue rarely arises in a standard urban-flat purchase with a clear history.

Where the risk is real: land and older titles

Land, particularly rural and suburban plots, is different. Historically, registration may have been less rigorous and boundaries less clear. A strip used by a neighbour for decades, gaps in title history or older peripheral development without a complete registration record are situations where usucapión deserves serious attention. For DNPI's land and suburban-asset strategy, this is a narrow but specific risk category requiring title-history checks rather than a seller's general assurance that 'the boundaries have always been like this'.

How to check in practice

Title-history review is part of general due diligence, but usucapión requires particular attention to plot boundaries, the duration of neighbours' possession and the completeness of registration over a long period, not just recent years. A useful warning sign is a mismatch between cadastral boundaries and actual fencing or land use. If a neighbour has cultivated land for years beyond a fence that does not match the legal boundary, investigate rather than ignore it. A city flat with a clear registration history does not warrant a separate deep investigation of this risk: focus effort where probability is higher.
