Registro de la Propiedad: why the escritura is not the end of the deal
Signing before the notary formalises the deal, but full protection of your ownership against third parties only comes once it is entered in the Land Registry. We look at how long that takes and what can hold it up.
The escritura signed before a notary transfers ownership between the parties, but full protection against third parties only comes with the entry in the Registro de la Propiedad (Land Registry). Registration can take anywhere from a few weeks to a couple of months, and that gap should be built into the deal timeline from the outset.
Escritura and registration are separate events
Signing the escritura pública before a notary legally formalises the transfer of ownership between the parties. Full protection against third parties, including priority over any later claims on the property, arises once the entry is made in the Registro de la Propiedad. There is a time gap between these two moments, and an investor is better off knowing about it before the purchase.
How long registration takes
Straight after the escritura is signed, the notary usually sends a preliminary electronic notice to the registry. This temporarily protects the deal's priority. Full registration, with all the documents and proof of tax payment processed, can take from a few weeks to a couple of months. The timing depends on the workload of the particular registry office and the complexity of the deed.
What can delay registration
Registration can be suspended until the problem is fixed if issues with earlier charges remain unresolved, the property's cadastral description contains errors, or there is no proof of the tax return and payment: ITP or, on a purchase subject to IVA, AJD. Any one of these is enough. Without proof of the tax, the registry will not accept the deed (art. 54 of the ITP and AJD law); the IVA itself is paid to the seller together with the price. That is why thorough due diligence and a nota simple before the purchase reduce the risk of delay after it.
What it means in practice for an investor
Until registration is complete, your ownership is not fully established as against third parties. This matters if you are planning a quick resale or a loan secured on a property you have just bought. The overall deal timeline, including this stage, is set out on the DNPI approach page.
Questions and answers
Can renovation work start before registration is complete?
Usually yes: possession and the right to deal with the property pass to the buyer with the escritura. Check any specific restrictions with a lawyer, as they depend on the details of the deal and on whether there is financing.
What if registration uncovers a problem after the escritura has been signed?
The registrar can suspend or refuse the entry until the problem is resolved. Unwinding a deal after the escritura is far harder than finding the problem before it, which is why the full property check is done in advance.
